In July, Brickz was found guilty of raping his 16-year-old niece, at his home in November 2013. Ndlovu was arrested in November 2013 and had been out on R50 000 bail throughout the trial. The musician will remain in custody until October 17 when sentencing will resume.

In mitigation of sentencing, the defense lawyer Piet Du Plessis for Brickz told the court not to hand down a sentence merely to satisfy the outcry of society, which may not be rational. As part of the argument in court, the defence reminded the court that Brickz was already serving his punishment for disappointing his fans and destroying his musical career.
