New High Court ruling lessens Babu Owino´s bail terms

Tuesday, the 3rd of March, the high court relieved Babu Owino of half his cash bail and challenged his payment of DJ Evolve´s hospital bill as misplaced.

The Embakasi East MP´s wishes had finally come to reality after High Court Judge, Luka Kimaru ruled that the politician should not be forced into paying the DJ´s hospital bill.

According to the judge, payment of the entertainer´s pending bill should be considered a moral obligation and not forced on him by any means.

The accused person should continue paying the hospital bill as a moral duty to him, not as a court order. If he fails to pay, it is up to him and his God.

Further stating that payment of the hospital bill by the legislator does not in any way imply that he was guilty of the attempted murder charges.

Speaking to Kenyans.co.ke, Babu Owino admitted that the hospital bills are not a walk in the park, sharing:

It is a little too much, but I will continue paying the bills.

So far, a payment of Ksh 4.4 million has been made according to the bail terms, with a remaining Ksh 600,000 that will see him get remanded until it is cleared.

Re-consideration

On the 27th of January, the youthful MP had applied for a cash bail reduction, seeking an alternative bond.

In an application filed to the court, Babu revealed that it was proving difficult for him to meet the cash bail terms, being a little too hefty for him.

I have partially compiled with the terms as set out and thus I am out on bail but I know that I thus would also appreciate an and above a reduction of the amounts stated being Ksh 10 Million.

Just to clarify, the Embakasi East lawmaker stated that paying the DJ´s hopital bills, does not in any way mean that he is guilty of the shooting.

Despite the fact that I had voluntarily started assisting the victim in meeting the medical expenses and had pledged to voluntarily continue doing so, at no point was it to depict an admission of guilt as the Court seems to have depicted. Thus, the same should not be used to render high or punitive bail terms.

Milimani Chief Magistrate Francis Andayi who had made the earlier court ruling of Ksh 10 Million cash bail, stepped down following objections from DPP Noordin Haji.

Admitted DJ Evolve´s escalating hospital bill has compelled Embakasi MP Babu Owino and his legal team to respond urgently.

The DJ´s ballooning bill at Nairobi Hospital raised concerns after family revealed they were unable to meet the hefty bill.

However, Babu Owino´s lawyers responded to the same, first exposing media reports for lacking facts and accuracy in their information.

The news item published by ourselves on February 20, 2020 with regards to this matter has elicited a lot of concern and emotions from the public. The said story, as ran by our television station, was not accurate, truthful and indeed at no given point was our client or the honorable courts consulted.

Secondly, the legal team believes the courts, nor clients from both parties were consulted before the publication that went viral.

Cash bail deposits

Adding that Babu Owino paid up the cash bail as directed by the courts. So far having deposited Ksh 5 million in the bank.

If indeed our clients and the honorable courts were consulted, then it would have been easy to establish for a fact that our client has, up to date, paid a total of Ksh 5 million which principally is channeled towards the treatment of the victim.

Further disclosing that once their client, Babu Owino deposits the cash as directed, the money is now with the court.

So Babu had no control of the funds once deposited at the bank.

Unfortunately, the court orders indicated that these monies were to be paid directly to the honorable courts. Which would then facilitate the release of funds, on a monthly basis to Nairobi Hospital where the victim is hospitalized. This essentially mean that our client has no control of the funds once he has deposited the same from the courts.

Therefore, the lawyers said there is no need for the DJ´s family to raise concerns on the same.

The long and short of this is that both our clients and the honorable courts has already given assurance as to the medical issues of the victim. It should be the last thing that the victim and the family should be made worrying at this particular point.

DJ Evolve´s dad worried of his son´s pending hospital bill

Previously, DJ Evolve´s father stated the hospital is putting pressure on them to clear the bill but they didn´t know how to tend to that.

We have been receiving calls from the hospital asking us to settle the medical bill. We can´t raise the needed Ksh 7.5 million even if we were to sell a majority of our property.

DJ Evolve´s escalating hospital bill, worries his parents

DJ Evolve is still in critical condition a month after the scuffle at Nairobi´s B Club but even worse, is his ballooning hospital bill.

The entertainer is at Nairobi Hospital´s Intensive Care Unit (ICU) where he has been receiving treatment but his hospital bill is hitting the roof each passing day.

Currently at Ksh 6.9 million as of Wednesday, 19th February, and this is worrying his parents.

Up and close on K24, the DJ´s parents expressed uneasiness over their son´s skyrocketing hospital bill which they say is beyond their means.

The hospital has been asking us to offset the bill but we cannot afford it even if we were to sell a majority of our land.

The bill was initially to be settled by the Embakasi legislator as installments of his cash bail but that is yet to fully happen.

According to Orinda´s parents, the last payment made by Babu Owino was his first bail of Ksh 2.5 million. Since then, nothing more has been received from him.

Further revealing that the disk jockey is still in critical condition. He cannot speak and the doctors are feeding him with tubes.
