Safaricom hasn’t paid me the Ksh 4.5 million they owe -Bamboo

In 2023, the High Court awarded rapper Bamboo Ksh4.5 million in a copyright infringement case against Safaricom and two premium rate service providers (PRSPs). The court found that Safaricom had used three of Bamboo’s songs—’Mama Africa’ (2005), ‘Yes Indeed’ (2005), and ‘Move On’ (2012)—on its Skiza Tune platform without his authorization.

Despite the favorable ruling, Bamboo has yet to receive the awarded amount. Safaricom and one of the PRSPs filed an appeal against the decision, leading the court to order the deposit of the Ksh4.5 million into an interest-bearing account pending the appeal’s outcome. Bamboo noted that while the defendants complied with this directive, Bernsoft Interactive Limited, one of the PRSPs, did not make the required deposit.

Bamboo initiated legal action in December 2015, alleging that Safaricom and the two PRSPs had used his intellectual property without consent, generating revenue from his songs while excluding him from the profits. The PRSPs contended that they had authorization from the Music Copyright Society of Kenya (MCSK) to distribute the songs to Skiza Tunes, as Bamboo was a member. However, MCSK acknowledged an error upon Bamboo’s complaint, confirming that there was no agreement permitting them to distribute his songs. They subsequently compensated him with Ksh600,000.

As the appeal process unfolds, Bamboo remains in anticipation of the final resolution and the potential receipt of the awarded damages.
