A Kenyan man who stopped paying monthly maintenance for his unborn child with his ex-girlfriend could face a one-month jail sentence if he fails to make all back payments within two weeks.
The man, identified as I.S., was ordered by the High Court to pay the woman, N.E.W., Sh80,000 per month in maintenance for the child. He had agreed to this amount in a consent judgment that was upheld by Justice Antony Mrima.
However, I.S. stopped making the payments in January 2022. He claimed that his business had been affected by the COVID-19 pandemic and that he could only afford to pay Sh40,000 per month.
The woman filed a contempt of court application against I.S., and the court has now ordered him to pay the arrears of Sh80,000 per month within 15 days. If he fails to do so, he will be sentenced to 30 days in civil detention.
The woman said that she needed the money to support her unborn child, as she was unemployed and had been experiencing mental upheaval during the pregnancy.
I.S. has not yet commented on the court’s decision.
