CS broke the law in sacking Technical University of Mombasa VC, court told

Education CS Fred Matiang’i broke the law when he fired former Technical University of Mombasa VC Josephat Mwatelah, a court heard on Thursday.
Mwatelah’s lawyer Habert Ashiruma said that the University Council and not the CS is tasked with disciplining staff members.
In May this year, Matiang’i overruled the University Council which had given Mwatelah a warning letter following investigations that raised concerns over his integrity, abuse of office and maladministration and sacked the former VC.
The CS went further to write to the Ethics and Anti-Corruption Commission (EACC)asking it to investigate Mwatelah.
However, the decision proved unpopular on the ground with Coast leaders demanding an immediate reinstatement of Mwatelah as the TUM Vice Chancellor.
The leaders led by Kilifi Governor Amason Kingi, claimed Mwatela’s sacking was a political punishment for not supporting Jubilee in the 2013 polls.
 
He added the Jubilee Government was frustrating Coast professionals ever since they took over power in 2013.

Mwatelah’s lawyer  told the court that the University Council did not recommend the Vice Chancellor’s sacking and it was agreed upon that he would eventually return to work.
Mwatelah has now demanded a Sh54 million compensation should he not be reinstated to his former position.
The judge, Justice Onesmus Makau said that he will deliver his ruling on January 27 next year.
