Court Declines To Withdraw Case Against 6 Kayole Men Accused Of Stripping 2 Sisters Despite Forgiveness From Victims

 

A court in Nairobi has declined an application to drop charges against six men accused of stripping and robbing two sisters in Kayole late last year.

The six had made an application to be set free after the victims told court that they had forgiven them and would want charges against them withdrawn.

Makadara Principal Magisrate Caro Ocharo said that the charges cannot be dropped because the case is of public interest regardless of the fact that the victims have forgiven them.

The magistrate said she cannot allow the case to be withdrawn because it is only the Director of Public Prosecutions who has the mandate to do so.

She added that she will be contravening the constitution if she allowed the suspects to walk away without facing charges.

The suspects’ parents had pleaded with the victims to drop the charges facing them, something that the victims accepted.

Michael Kamau, Zachary Gitonga, Kelvin Njuguna, David Kinuthia, Lawrence Kuria and Hosea Kassim are charged with stripping and violently robbing Nyambura of her mobile phone, 61 eggs and Sh950 in cash all worth Sh10,290.
